Do I have to give the police my smart phone or IPhone password

Michael DeRiso Answers Your Questions

Do I have to give the police my smart phone or IPhone password?

No….they need a search warrant to view the contents of your phone. With the new IOS8 operating system, used by apple, there is no way to get into a phone that is password protected. Apple has announced that they will no longer honor search warrants as there is no way to access the information from a password protected phone. However, if store information in ICloud, you information may be subject to search through a search warrant. If law enforcement does get a search warrant, you are not required under the law to give them your password.
