Do I have to answer a police officer if they are asking me questions

Micahel DeRiso Answers Your Quetions

Do I have to answer a police officer if they are asking me questions?

You never have to answer a police officer’s questions whether you are under arrest or not. Law enforcement can certainly ask any question they would like, however, you have a constitutionally guaranteed right to remain silent and not talk to them. That means that you do not have to answer any questions, ever. However, you have to actively assert your right to counsel by saying “I want a lawyer”, or they may just let you sit there and continue to ask questions. After you say this, say no more.
