Should I submit to a chemical test - Breathalyzer or Blood Test at DUI Stop

Michael Deriso Answers Your Questions

Should I submit to a chemical test (breathalyzer/blood) if requested to do so after being stopped for DUI?

If this is your first or second DUI, you should absolutely submit to law enforcement’s request for a chemical test. Whether it is a blood test or a breathalyzer, you will only suffer greater harm by refusing. By refusing to submit, you will automatically lose your driver’s license for one year in addition to any penalty imposed if you are convicted of the DUI. If you are ARD eligible, your maximum suspension is 90 days, by refusing to submit to a chemical test, your suspension will be one year plus the additional suspension.
